• Criminal proceedings are not grounds for preventing someone from appearing before a rehabilitation committee. Recently, a social worker who supports a person with a psychosocial disability approached us. The person sought to receive community rehabilitation services. He met the eligibility requirements set out in the Community Rehabilitation of People with Mental Disabilities Law: an Israeli resident, over the age of 18, with at least 40% medical disability due to a mental condition. Yet despite this, he was denied the opportunity to appear before a regional rehabilitation committee because criminal proceedings were underway against him. In practice, he was denied the rehabilitation services he sought. At this stage, we at Bizchut approached the Health Ministry and clarified: the law establishes the eligibility requirements for community rehabilitation services

  הליך פלילי אינו עילה למנוע מאדם להגיע לוועדת שיקום. לאחרונה פנה אלינו עובד סוציאלי המלווה אדם עם מוגבלות נפשית, שביקש לקבל שירותי שיקום בקהילה. האדם עמד בתנאי הזכאות הקבועים בחוק שיקום מתמודדי נפש בקהילה: תושב ישראל, מעל גיל 18, עם נכות רפואית על רקע נפשי בשיעור של 40% לפחות אבל למרות זאת נמנעה ממנו האפשרות להגיע לוועדת שיקום אזורית, בשל הליך פלילי המתנהל בעניינו. בפועל נמנעו ממנו שירותי השיקום שביקש לקבל. בשלב הזה פנינו מבזכות למשרד הבריאות והבהרנו: החוק קובע את התנאים לזכאות לשירותי שיקום בקהי
